Terms of Service

These Terms of Service ("Terms") govern your use of trouttips.com and the TroutTips iOS app (together, the "Service"), operated as TroutTips ("TroutTips," "we," "us," or "our"). By creating an account, subscribing to TroutTips Pro, or otherwise using the Service, you agree to these Terms. If you don't agree, please don't use the Service.

1. The Service

TroutTips is a reference tool for trout anglers in Colorado, providing river conditions, rig and fly pairing suggestions, a fly pattern finder, a fly shop directory, and rod comparisons. Every lookup tool on TroutTips is free to use without an account. A free account adds saved favorites and real-time alerts for a limited number of items; TroutTips Pro removes those limits and unlocks additional detail, as described on the pricing section of the site.

2. Accounts

You need an account to save favorites or set up river alerts. You're responsible for keeping your password confidential and for all activity under your account. Provide accurate information when you sign up, and let us know at the contact below if you believe your account has been compromised. You must be at least 13 years old to create an account.

3. Pro subscriptions, free trial, and billing

TroutTips Pro is offered on a monthly ($4.99/mo) or yearly ($29.99/yr) subscription, billed through Stripe, our payment processor. New Pro subscriptions start with a free trial. Your first charge is scheduled for seven days after we send your first prime-flow email during that trial, or 30 days after the trial starts, whichever comes first. If no prime-flow email is sent, your trial ends after 30 days. Later alerts do not restart or extend the trial. Cancel before your trial ends and you will not be charged.

What counts for trial billing: A prime-flow email (the qualifying alert) is an email reporting a watched river in its optimal flow range, with no known active closure or temperature warning. A river already in that range when you start watching it can therefore count at the next check. A prime-flow email may also be sent when the river returns to that range or a known safety warning clears while flow remains optimal. Only the first such email sent during your Pro trial starts the seven-day countdown. Active mandatory or voluntary closures and temperature warnings suppress new prime-flow emails and their billing trigger.

What does not count: Tough-fishing, high-flow, low-flow, dry-gauge, water-temperature, closure and reopening notices, a signup conditions summary, other summaries, and push notifications do not start the countdown or reset it. Pro subscribers, including those in a free trial, receive condition-change emails for watched rivers covering prime flow, adverse flow conditions, temperature warnings, closures and reopenings. A separate eligible prime-flow email can count even if a nonqualifying recovery or reopening notice is sent around the same time.

Alert coverage: Free accounts retain prime-flow emails for their favorited rivers within the free-plan limit. On-site temperature warnings and closure notices remain free for every plan. Alerts reflect conditions detected during automatic checks, not continuous observation or a guarantee that every hazard or restriction will be detected. Temperature sensors are not available at every gauge, and gauge or closure data may be delayed or unavailable. A prime-flow email is not an assurance that fishing is safe or legal; verify current conditions and official restrictions before fishing.

For this billing rule, an email is sent when our email provider accepts it for sending and records that timestamp. Inbox delivery, opening the email, and clicking it are not required. The seven-day period is measured from that timestamp, capped at the original 30-day trial end.

If your first prime-flow email is sent with fewer than seven days left in the original 30-day trial, only that remaining time is free. For example, an alert on day 2 schedules billing for day 9, an alert on day 21 schedules billing for day 28, and an alert on day 27 leaves billing on day 30. We will notify you of the scheduled billing date and provide cancellation instructions.

Once your free trial ends, your subscription automatically converts to a paid, recurring subscription at the plan price you selected, and you authorize us to charge your payment method on each renewal date until you cancel. You can see your current plan and scheduled billing date from Manage billing in the account menu.

4. Cancellations and refunds

You can cancel your Pro subscription at any time from the account menu (Manage billing), which takes you to Stripe's billing portal. Cancelling stops future renewals; you keep Pro access through the end of the period you already paid for.

No refunds after conversion. Because the free trial gives you a full opportunity to try Pro and cancel before being charged, once your trial has converted to a paid subscription and a charge has been made, that charge is final and non-refundable, including for partial billing periods, except where required by law.

5. Acceptable use

Use the Service only for its intended purpose of planning and improving your own trout fishing. Don't:

• Attempt to circumvent free-tier limits, paywalls, or account restrictions through automated means, shared/multiple accounts, or other workarounds.
• Scrape, copy, or republish TroutTips' data (river conditions, fly pairings, rod comparisons, fly shop listings, or similar) at scale for a competing product or service.
• Interfere with or disrupt the Service, attempt to gain unauthorized access to it, or use it in a way that could damage, disable, or impair it.
• Use the Service for anything unlawful, fraudulent, or harmful to others.

6. Content, accuracy, and no professional advice

River flow data, rig and fly suggestions, closures, and other information on TroutTips are drawn from public gauges, fly-shop reports, and other third-party sources, and are provided for general reference only. Conditions on the water change quickly and can differ from what's shown. Always check current Colorado Parks and Wildlife (CPW) regulations, fly-only water restrictions, and closures directly with CPW before you fish, and use your own judgment about safety and conditions. TroutTips is not a substitute for official regulatory information and we aren't liable for outcomes from relying on information in the Service.

7. Intellectual property

The Service, including its design, software, and original written content, is owned by TroutTips and protected by applicable intellectual property laws. We don't claim ownership over publicly sourced factual data (such as public river gauge readings or published regulations) that we compile and present. You may not copy, modify, or redistribute the Service itself without our permission.

8. Third-party services

The Service relies on third-party providers, including Stripe for billing, Supabase for data storage, Resend for email delivery, OneSignal for push notifications, and Google Analytics/Search Console for usage insight. Your use of features backed by these providers is also subject to their own terms where applicable. See our Privacy Policy for details on what's shared with each provider.

9. Termination

You can stop using the Service and delete your account at any time from the account menu (Delete account), which cancels any active subscription immediately and removes your favorites, alerts, saved items, and account record. We may suspend or terminate accounts that violate these Terms, including the acceptable-use rules above.

10. Disclaimers and limitation of liability

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including accuracy, reliability, or fitness for a particular purpose. To the fullest extent permitted by law, TroutTips is not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including reliance on river condition, fly pairing, closure, or other content. Nothing in these Terms limits liability where it cannot legally be limited.

11. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll update the effective date above and, where appropriate, provide additional notice (such as an in-app notice or email). Continuing to use the Service after changes take effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the State of Colorado, USA, without regard to conflict-of-law principles.
